The Special Judge for CBI Cases, Mirzapur, Ahmedabad has convicted accused Shri Piyush Gajjar and Shri Mohammad Hanif Gohil, both private persons U/s 120-B, 420,467,468,471 of IPC and sentenced them to undergo five years Rigorous Imprisonment with fine of Rs.50,000/-
CBI registered a case on 27.04.1988 on the basis of a complaint received from ONGC, Vadodara(Gujrat). It was alleged that private persons opened a Bank Account in the name of a fictitious company and prepared forged running bills for the work which was not allotted by the ONGC. In conspiracy with them, the accused public servant of ONGC had made payment to the said fictitious company to the tune of Rs.17.54 lacs.
The Trial Court found both the private persons guilty and convicted them whereas the then Deputy Director (Finance & Accounts), ONGC, Ankleshwar and the then Accounts Assistant, both of ONGC, Ankleshwar were acquitted. Another accused the then Finance & Accounts Officer, ONGC, Ankleshwar, expired during the course of trial.
