An FIR No 59/2013 against Facebook Inc. and others has been registered by IPS officer Amitabh Thakur and social activist Nutan Thakur in the Gomti Nagar police station Lucknow under section 153A, 153 153-B, 290, 504, IPC and section 66 A Information Technology Act 2000.Investigation shall be done by Cyber Crime Cell, Hazratganj.
The complaint says that at a Facebook group Mullaguru Acharya Swami Baba open abuses and dirty words are used against Hindu and Islam religion and also against Prophet Mohammad and Hindu Gods and Goddess. These dirty words and abuses are of such nature that they are wantonly giving provocation with intent to cause riot and doing acts prejudicial to maintenance of harmony (153A IPC), Imputations, assertions prejudicial to national-integration (sec 153 B IPC), public nuisance (290 IPC), Intentional insult with intent to provoke breach of the peace (sec 504 IPC and using Information Technology for these purposes (sec 66A IT Act). The complaint presented by Amitabh and Nutan says that all these words are such that they have been used to intentionally and deliberately provoke the above mentioned crimes.
The complaint says that even before these similar activities had been done on Facebook and three FIRs were registered against Facebook by them at Gomtinagar and Civil Lines, Meerut police station but since no action was taken in these cases, hence such incidents are recurring.
The FIR says that Facebook Inc, Headquartered at Pao Alto, California, USA is criminally liable because it has not taken the due precaution as warranted under section 79 of the IT Act and various Rules of the IT (Intermediary Guidelines) Rules 2011 despite orders of Allahabad High Court in two writ petitions filed by Amitabh and Nutan.
