My children Tanaya and Aditya Thakur had presented an FIR before the Gomtinagar Police station against Nirmaljit Singh Narula alias Nirmal Baba as regards his alleged cheating of common people by creating Godly fear and by suggesting extremely simplistic solutions. When the police did not register the FIR, they went to CJM, Lucknow on whose FIR No 202/12 under section 417/419/ 420/508 IPC was registered on 12 May 2012.
When, after recording of our statements, we saw no progress in this investigation, I wrote a letter to DGP, UP on 19 September 2012 presenting an order delivered on 14 September by Delhi High Court in CS(OS) No 1518/2012 which indicted Nirmal Baba for simplistic solutions and requesting for proper investigation. .
In the meantime, when I contacted the Investigating Officer (IO) Rajesh Kumar Singh, he went on telling that the investigation was under progress. Later, through further enquiry, I came to know that the IO had closed the investigation on 02 August itself, saying that since the informant had not produced any victim nor any other evidence, hence Final Report was being sent. All that the IO did was to register my and the children’s statement in Case Diary No 2 and Nirmal Baba’s and his supporters’ statements in Case Diary No 4 on 31 August. It was lucky that the Circle Officer, Gomtinagar disagreed with the Final Report and sent it back, the investigation now being done by SI B R Nirmal.
Thus in a case registered on the orders of CJM, Lucknow and related with larger Public Interest, the Lucknow police did not n evattempt contacting any victim or the informants. The IO had issued a notice under section 160 CrPC against Nirmal Baba on 16 May where he had asked for information on 9 points including the Rules, Regulations and Memorandum of the Trust, the Income Tax return for the last 10 years, Passbooks of his Bank accounts etc. But surprisingly none of the points in this Notice find reference in the Case Diaries nor has the Notice been included there.
Thus it is clear that the Lucknow police deliberately opted for poor investigation. Now I have written a letter to DGP, UP on 01 November requesting him to take action against the previous IO and to get the further investigation done by a DySP under personal supervision of DIG, Lucknow Range.
