SRINAGAR, July 28: Public Prosecutor (PP) Mushtaq Ahmad Gattoo today presented his objections before the sessions court in Shopian and prayed that the four cops, arrested in the connection with rape and murder case, should not be granted bail.
Reports said that amid tight security arrangements, four police cops were presented before the district and sessions judge. Defence counsels, Asim Maharwatra and Abhijeet argued before the court that special investigation team of police has falsely implicated the cops in rape and murder case. The defence lawyers argued that on the arrest of police cops, the state government itself has stated that there was no solid evidence against the cops but they have been arrested on the basis of suspicion and the investigating team of police too has stated the same.
Public Prosecutor, Mushtaq Ahmad Gatoo presented objections to deny bail to the arrested cops. Mushtaq argued that when the incident occurred during the intervening night of May 29 and 30, all four police including SP Javid Iqbal Matoo and Dy SP, Rohit Basogtra cops were on duty and instead of gathering the evidences into the case, the accused cops destroyed the same.
He said that the accused cops did not register FIR in the case even after DC told the e then SP, Javid Iqbal Matoo to register FIR. The PP cited yet another objection stating that arrested cops had earlier stated that Asiya and Nelofar died due to the drowning and were not raped and murdered and claimed that the accused police cops were involved in deep criminal conspiracy under section 120, which upholds that the accused be given life imprisonment or hanged to death.
Quoting the judicial inquiry report before court, the Mushat Gattoo argued that the accused SP has lied before the commission and if the police cops were not guilty, why were they denying Narco analysis test.
Referring to a Supreme Court ruling, PP told the court that under section 120, the criminal conspirators are equally responsible for the act and it is very difficult to gather proof or find out witnesses in a case of criminal conspiracy as the circumstances often remain subtle, unclear and unpredictable.
Citing more objections, Mushtaq Gatoo told the court if the accused cops were released they will do everything to destroy the evidence. He submitted before the court that the bail plea of the accused be rejected to ensure that investigations into the case are conducted smoothly. Following number of objections by public prosecutor, the court deferred the bail plea hearing till tomorrow.
It may be mentioned here that on behalf of relatives of victims, Asiya and Nelofar, chairman fact finding team of Shopian bar association, Mohammad Yusuf Bhat, will present arguments before the court and the public prosecutor will also submit objections to deny the bail to the accused police cops tomorrow.
