HC DIRECTS HARYANA GOVERNMENT COUNSEL TO TAKE SPECIFIC INSTRUCTIONS FROM GOVERNMENT ABOUT PAYMENT OF COMPENSATION TO PETITIONER-CHANDERPATI:
Justice Ritu Bahri today directed Haryana Government Counsel to take clear and specific instructions from the Government regarding payment of compensation to Chanderpati, the widowed mother of Manoj; Justice Bahri observed in her order that the compensation payable to Chanderpati in this case is not to be connected with the PIL pending in the High Court on the issue of framing of policy by the Haryana Government for payment of compensation to victims of crime; During resumed hearing of the case today. The Haryana Government’s Counsel had requested that this case be deferred till the Haryana Government frames a policy for payment of compensation to victims of crimes under the Criminal Procedure Code, 1973; This contention was, however, stoutly opposed by H.C. Arora, Counsel for petitioner, who contended that liability to pay compensation in this case is due to failure of Haryana Police to protect the lives of Manoj and Babli, and it has nothing to do with framing of general policy for payment of compensation to victims of crime in general.
It is pertinent to note that in her 10 February order, Justice Bahri had given an opportunity to Haryana Government Counsel to seek instructions from the Government for payment of Rs. 6 lakhs as compensation to the petitioner, and had adjourned the case to 25 February, when again case was adjourned for today at the request of Haryana Government’s Counsel.
