Chandigarh 8th July, 2015; 18 years has been a very long period when a proposal was submitted by PGI MTA before PGI Administration to remove Cadre Anomaly of Medical Technologists created while implementing the 2nd Cadre Review Report in 1997-98 w.e.f. 1.3.1992.
In the year 2003, a Cadre Anomaly Committee under Prof. (Mrs.) Sudha Suri, the then Dean was constituted with 7 more Professors as its members. On 31.1.2005, the Cadre Anomaly Committee under the Chairpersonship of the then Dean submitted its report after series of meetings with MTA. On 3.5.2006, the recommendations were placed before SFC, which referred the case to Ministry of Health and F.W.
There has been no further action for about years unless the PGI MTA observed one day Mass Casual Leave on 10.9.2007, the recommendations were placed before Governing Body on 11.12.2007. The Governing Body was pleased to approve the proposal in principle and raised few minor observations to be looked into by Ministry of Health and F.W.
The PGI went into deep slumber again forcing MTA to resort to strike in April, 2008 from 15.4.2008 to 25.4.2008, which was withdrawn after the assurances by Hon’ble High Court in PIL.
On 2.5.2009, the modified recommendations of Sub-Committee were sent to MHFW. On 1.6.2009, the MHFW made more observations while the PIL was pending.
Finally on 29.9.2010, it submitted report with further modifications. On 10.1.2011, these were sent to MHFW. Finally, the MHFW approved the proposal and sent it further to Department of Expenditure (DoE), Ministry of Finance.
On 29.5.2012 and thereafter, DoE has raised few observations, which were addressed in consultation with MTA but the matter remained pending with it since then.
On 10.7.2013, the Hon’ble CAT made the following directions in TA No. 12 of 2010 (IN CWP No. 4128 of 1994);
“We would, accordingly, dispose of this grievance with the grant of a direction that the competent authority may proceed to implement the Cadre Anomaly Committee report with the modifications made therein by the Sub Committee, w.e.f. the date it came to be implemented in the case of other categories of the employees of the PGIMER within two months from today.”
However, there has been no progress by DoE.
In May, 2014, Sh. Narendra Modi has taken over the reins of Central Government and within one year the case cleared, which has been lying pending with MHFW and DoE since May, 2006.
On 26th June, 2015, the MHFW has conveyed that DoE has finally approved it, which will be implemented after approval of Governing Body of PGI.
