Chandigarh 2nd April : The Director, PGIMER, Chandigarh has challenged the CAT judgment dated 10.7.2013 before the Hon’ble High Court by filing a writ petition, which was listed for hearing on 31.3.2014.
Hon’ble High Court has dismissed the writ petition by rejecting the plea of Director, PGI by passing speaking and reasoned orders in its judgment dated 31.3.2014. Copy attached.
The longest ever struggle of PGI Employees Union and PGI Medical Technologists Association under the aegis of the then Joint Action Committee started in February, 1994 has successfully completed its second phase. Though, the Unions / Associations had a written settlement with PGI Administration on 5.2.1997, out of which many demands were implemented bringing financial relief to thousands of employees. However, the non-faculty staff was cheated by PGI Administration by backtracking from the written settlement, which forced the non-faculty staff to resort to 4th inning of strike and agitations in 1997-1998.
The Hon’ble High Court once again intervened and resumed hearing in the case but PGI did not cooperate after the strike was withdrawn with the kind intervention of Hon’ble High Court. PGI MTA resorted to another strike from 15.4.2008 to 25.4.2008, the Hon’ble High Court once againt intervened and advised the MTA to withdraw strike, which was done on 25.4.2008.
Ultimately, the CWP No. 4128 of 1994 was transferred to Hon’ble CAT, Chandigarh by orders dated 14.1.2010. On 10.7.2013, 27 out of 28 demands were decided in favour of non-faculty staff. There was a ray of hope that DPGI and U.O.I. will see reasons and implement the CAT judgement dated 10.7.2013 of 121 pages within the time prescribed by the Hon’ble CAT, Chandigarh, therefore, the PGI MTA did not deem it fit to file contempt petition before the Hon’ble CAT, Chandigarh.
However, it did not happen for about 8 months. Though, there was nothing legally as well as administratively to challenge the CAT judgment dated 10.7.2013 but on 31.3.2014, the DPGI filed a writ petition, consisting of about 2100 pages, against the CAT judgment.
The Division Bench of Hon’ble High Court has dismissed the writ petition of PGI in limine by passing speaking and reasoned order. Copy of judgment is attached for your kind perusal. It is believed that DPGI will file the Special Leave Petition before the Hon’ble Supreme Court in due course of time.
