ALL THE CASES INVOLVING tainted Punjab Police officials, including the PILs seeking removal of all convicted Cops, were adjourned to Dec.14th by Division Bench comprising Justice M.M. Kumar and Justice R.N. Raina today in pursuance to the orders issued by Supreme Court of India in two SLPs filed by the State Government against various interim orders issued by the HC Bench.
It is pertinent to notice that both the SLPs filed by State of Punjab were dismissed by Supreme Court on November 25th. However, the Supreme Court Bench headed by Justice D.K. Jain had noted down the assurance of the Counsel of State Government that the various directions issued by the HC shall be complied with by the State Government within two weeks, and requested the HC to accordingly adjourn the hearing of the said two cases wherein the HC had on its own issued notices to State of Punjab.
The SC Bench had in the third SLP filed by State Government against H.C. Arora, vacated the interim order issued by HC Bench vide which the Circular of DGP Punjab (directing for giving lenient treatment to those convicted police officials who were imposed sentence of imprisonment of less than 3 years) was stayed. The Supreme Court, however, had given liberty to the HC to proceed with this PIL and to decide it on merits, notwithstanding pendency of the SLP.
The Bench of HC, however, after noticing the orders of Supreme Court passed in the three SLPs, adjourned further hearing in all cases involving tainted as well as convicted Police Cops to December 14th. Thus, the COCP filed by H.C. Arora against S.C. Aggarwal, Chief Secretary, for not removing convicted Government employees from service, including DSP Bhupinder Singh Khatra, also stands adjourned to December 14th.
