Chandigarh 13th Oct; The Prime Minister and Ministry of Law and Justice have been requested that a suitable amendment may be made in the SC / HC / CAT Act and Rules and if need be in Bar Council of India Act / Rules so that an Authorised Representative other than a registered Advocate / Pleader can plead the court case of a citizen / employee in Courts / Administrative Tribunal.
It is an admitted fact that justice is not being denied but it has become very costly.
The Advocates are charging hefty fees. Poor people & employees cannot afford to pay fee ranging from Rs. 22,000 to 5 lacs or even more.Therefore, they have to live with injustice. A citizen / employee can plead in person in Courts / CAT. A citizen / employee can also be represented by an Authorised Representative(AR) in Labour Court and other industrial disputes authorities but Authorised Representative can not plead the case of a citizen / employee in Courts /Administrative Tribunals.
No doubt, one can arrange an Authorised Representative free of cost or at very nominal expense. The PMO / Ministry of Law and Justice have, therefore, been requested that Government should make amendments in the Supreme Court / High Court and Central Administrative Tribunal Act and Rules & even in Bar Council of India Act, if need be, to allow representation of a case of a citizen / employee by Authorised Representative other than a registered Advocate / Pleader.
Whether Government can fix the remunerations of Advocates in various type of cases under the Bar Council of India Act or not but it will not be practically viable and possible because there will be possibilities of violations and they may receive underhand fees. Therefore, it has been suggested / requested that the amendemnets may be made to allow Authorised Representatives in Courts / Tribunals.
I am sure this positive reform will bring the justice within the reach of common man.
