The government has said it may consider setting up of a Supreme Court bench in South India, provided it receive a recommendation from the Chief Justice of India.Law Minister M Veerappa Moily informed the Lok Sabha on Thursday that so far no proposal has been received from the CJI on the matter.
The CJI can propose or recommend setting up of the bench under provisions of Article 130 of the Constitution.In a written reply, Moily said setting up of benches of High Courts away from their principal seats will be considered by the Central government after receipt of a "complete proposal" from the State governments. It should have the consent of the Chief Justice of the concerned High Court.
He said no such proposal has been received by the Central Government.
