Special Courts for Women
Twelve Special courts for women have been established in Ahmednagar, Aurangabad, Akola, Amravati, Buldhana, Beed, Jalgaon, Nagpur, Yavatmal, Thane, Pune, Kolhapur and Mumbai. These courts concentrate on the Indian Penal Code Sections like 498-(A), 306 (B), 375 and also other sections related to atrocities against women.
Family Courts for Women
Family Courts were established for Women under the Family Courts Act, 1984, in the country. The first Family Court for Women in Maharashtra was set up in Pune in 1988, and a Family court was set up in Mumbai in 1989. Today there are 16 Family Courts in the state, 7 in Mumbai, 5 in Pune, 2 in Aurangabad, 2 in Nagpur. These courts have been set up to provide for special avenues to promote conciliation, secure speedy settlement of disputes relating to marriage & family affairs. These courts are to be set up in every city with a population exceeding 10 lakhs. The jurisdiction of these courts pertain to the following issues: –
Matrimonial Relief, including nullity of marriage, judicial separation, divorce, restitution of conjugal rights, or declaration as to the validity of marriage or as to the matrimonial status of any person.
The property of the spouses or of either of them.
Declaration as to the legitimacy of any person.
Guardianship of a person or the custody of any minor.
Maintenance including proceedings under chapter 9 of the Code of Criminal Procedure.
During the stage of conciliation, the proceedings are informal. Advocates are normally not allowed in the Family Court. However, they are permitted in special circumstances. Appeal only lies to the High Court on orders passed by the Family Courts. The findings of the Counselling and Legal Advice Cell of the Commission while handling cases, matrimonial disputes and related matters pending in family courts have been brought to the notice of the Law and Judiciary Department and the Hon’ble High Court.
This again reveals that the Govt is only taking care of Women in Family. Is the family only comprising Women?????????????
Why Man is not a part of Family. The Maharashtra State Women Commission states that the Family Courts are setup for Distress women and by state Women Commission. Do anyone imagine that Man can ever get justice in Family Courts?????????????????????????????????????????
