20 June : Its shocking but yes its true, the Dy-Registrar of Co-op Housing societies for Bhayander Area Mrs.Mrinalini Heram has ignored a major lapse in the societies of Bhayander where most of the Society Committees have not submitted and nor made Indemnity Bonds. This is mandatory as per Bye Laws of the Co-op Housing Societies.
There is also a Court Ruling where the High Court of Mumbai had sacked the Committee Members who had not submitted Indemnity Bonds within 15 days of Assuming Office; this was brought to the Notice of Mrs.Heram who said yes 95% of Cheating or Mis-Appropriation of society funds is happening in Co-operative Housing Societies in Bhayander Area.
There is no check kept by the Deputy Registrar whether the Balance sheets of all societies have come or not, even after several complaints given to the Registrar office in writing no action is taken against the defaulting Society Committee’s.
There is Jungle law prevailing in every field in Bhayander Area and one more such example are the Housing societies of this area where 99% of Society Committees have not made Indemnity Bonds. I can say this because I have myself forwarded several complaints regarding one such society (Siddhivinayak Archid Co-operative Housing Society) along with the Court Ruling Copy to Mrs.Heram but it’s in vain. Now it’s up to the Law of our country to Question the Registrar who even after knowing the lapses has not taken any action.

Our builder located in surya orchid, ramadev park road , ramnagar, mira road est thane 401107 is not at all interested to form society since four years have passed . Moreover he charging exorbitant maintenance. Some of his flats and shops have not been sold but he has put those unsold flats and shops on rent but he is not paying a single penny towards maintenance for his unsold flats and commercial shops. We owners are bearing all the burden. As compared to other societies in our area where maintenance is mere rs 1.25 per sq ft but our builder is charging rs 2.50 per sq ft. He hasn’t made any society office . Our builder threaten that if we won’t pay such hefty maintenance he will disconnect or stop water and all other facilities. We are very disturbed to pay such hefty maintenance . We are living in mira road East 401107. Please advice what to do

I would like to make serious complaints against the committee members of 1A, Green Park CHS, Near J&K Bank, Shanti Park, Mira Road.
Since the last 15 years, no accounts have been shown to any member, AGM never held and lots of misdoings.
According to residents, misappropriation of funds is being done by the committee members. No elections are held since the beginning .

I want to know , if any of the owner want to conduct any ritual or function in society terrace.
Can society deny the request for the same.
And what if we want to conduct it anyways.
I just purchased a flat on ground floor, I am facing a problem on entrance of my flat water was stagnated as this water falls down from the window ac of upper floor’s members.
What action can I take for stopping this problem, as due this water my entrance become slipper and there is chance of fall down of any my family members.
If on highlighting to the society thought the problem not solved then what action I have to take?

Its a conplaint regarding non-registration/ Stamp Duty of a shop 1, in our building known as Om Riddhi Siddhi Apt, Navghar Road, Bhayander (EAst), This shop belongs to one of the Corporator (shop is in the name of her husband). The said building is 17 yrs old bldg and as now the society has decided to convence the same in our society’s name for which the amount is aslo collected for each and every member of the 60 flats and other two shops. The society had approched the owner for submission of the registered document several times, now almost two years only because of this Shop no.1 our convence is held up. Society members are scared to move ahead just because of her polictical background which people have expericed personally. Now since i have taken this initiative to approach you as i am also a member of this society its a risky thing for me too.
I am writing this letter only after getting the necessary information from the society. I request you to take strong step and action against this issue after finding out the truth. I really hope you will definitely take a drastic action this as the amount paid by each society flat member is their hard earn money it very valuable for us.

When we asked Mr S M Shrivastav [Former Secretary ] To explain the amount or why was the notice sent directly on our name. He denied being the secretary and could not explain the amount ,and does not know why the notice demanding money was sent on our name and told us to talk to Mr D D Kolte, since he is the Chairman of the society since 1996, from the time the society was registered, Till date…Even Mr Ashish Shetty [Secretary] and Mr Vijay Kadam [Treasurer] cannot explain the amount as well ..
We have complained about this issue even at the Sub/Joint Registrar Housing societies CBD… Navi Mumbai…The officer Mr Bhosle and Mr Thakur over there told us our papers are all clear and if the society does not make you a member they have the power to do so. However its been four years and no action has been taken. Till date. Our latest request for Membership in the society was once again given to the Sub/Joint Registrar of Co Operative Housing Societies CBD.on the 20th of April 2011..
The Chairman Mr D D Kolte told us to go to court regarding this issue… REASON BEST KNOWN TO HIM WHY ?? Has he and the others think they are the LANDLORDS of the society…Although this issue can be very well solved in the society it self ….
So as a consumer we filed a compliant in the Consumer Disputes Redressal Forum CBD Navi Mumbai…My Complaint No. 45/2010. In Feb 2010.. However when ever we were called to court several times.The society office bearers never came.. However surprisingly an Order was passed in Dec 2010 by the court, by Mr R D Mhetras [president], Mrs Jyoti A Mandhle [member] That this complaint cannot be put up in the Consumer Disputes Redressal Forum… In fact the court did not take any action or even ask the opposite party, why they never appeared in court when ever called, so many times in the past 11, months, But surprisingly the court passed an order after nearly a year that this complaint cannot be put up in the Consumer Disputes Redressal Forum.. After we paying the court fees for this case and also wasted One year of ours …
Then why were we called so many times to the court, was it just for formalities ,.. or was it just to waste our time and harass us as well,..didnt the court know this in the beginning. And they advertise ..JAGO GRAHAK JAGO..
In fact our latest request letter asking for Explanation Regarding The Amount The society Keep Demanding From Us, for no Reason was once again given to the Society dated 22nd Jan 2011. and a copy was also sent to their Advocate Mr Rajaram V Bansode [Advocate High Court]. But Till Date we have not received any reply or explanation regarding the amount from the society nor from their advocate..Reason best known to them, Why???
WHAT are their Intentions/Motives behinds this Demands and Harassment by the office bearers of the society??.. (Or is it only because we are Christians, Or is it because they are from a political party ?? As this request for Membership is pending for the past EIGHT years)…

Deputy Registrar ‘R’ Ward, Mr. Patil is very corrupt and do not follow any law written under the Maharashtra Co-operative Societies Act, 1960 and has been given quasi-judicial powers by the Government of Maharashtra. I do not know whether there is any audit of the work carried out by him. He forges eveything, even receipt of notice u/s 101 is forged. He is big shame to Govt. of Maharashtra.
Ms. Eram, Dy.Registrar has worked earlier in `T` ward, Mumbai-80. She is very corrupt official. She has been thrown -out from `T` ward. Now she is suspended from the services.
I have found that work at thane registrar office is going on is so bad that i can not tell you, i my case Mrinali madam has taken the society in same day when the complaint was raised and since then administrator is there, there was a fraud of around 40 lack Rs , it has been passed 11 months but until now noting has done, we request them to declare election but not yet done, i can say they are involve in bribe business,

My name is Awadhesh and I am staying in Mira Road , Near GCC Club. We have a society of 2 buildings having 28 flats in each building. I am staying on 2nd floor and our society Secretary R. H. Jafrey is staying on 1st floor. There is open terrace on 1st floor which slowly slowly he packed from all three sides with wall and put sheding on it. He also encroached part of my property and sheded that as well. Despite number of complaints he has not removed the encroachment. as shed is below my flat, whenever i open my window what i can see is the waste food items and all the garbages thrown by people from upper floors. he is not even cleaning the shed and now the condition is so bad that my family members has bee hospitalized several times as the shed is big disease generator because of all the waste materials lying on it and we are the one who are being burnt by this.
several complaints to the society, but all in veins, he openly came to my home and given threats to me and abused my family members several times. A complain has also been filed in police station but of no use. A complaint has also been filed in MBMC but nothing has happend.
Kindly suggest some advise that how can i get relief by making this shed demolished as the shed is being made without the permission of MBMC and Society and as it is on open terrace the permission can not be given by MBMC no matter how much money he pays to them.

As you say 99% societies in Mira Bhayander not yet file the indemenity bond. We are the 1% of that. We are file our committee member indemenity bond with 15 days after forming new committee. We have pan number, Tan Number, income tax file and audit A rating society call Jay Shubh Laxmi Co-Op Hsg Society, Kankia Road, next to Beverly Park, Mira Road (East), And aslo 1st society in Mira Bhayander received Conveyance Deed on 12th March 2009
Regarding M20 bond(indemnity bond) it shld be circulated to all members as certified true copies.It can also be displayed in the society room notice board.When it is mandatory it shld be easily accessed for anyone who wants to see it.

I thinks that you are totally confused and very wrongly doing such an act which are illegal. You have bribed the government official, you wants intervention of political personalities for your concerns, which is not a good practice. As you have mentioned that you have filed a RTI and you have not received any response in a acceptable time frame. Madam there number of NGO available to help an individual to fight for their right to information. You can contact them.
For your entire problems i suggests you to file a suit against your society and ask for justice from the judiciary. This process may take some time but you will surely gets the justice and the permanent solution of your problems and all the law breakers will gets punishment. Please consult a good advocate for the legal procedure.
request for your help , I am senior citizen 63 yrs old running from pillar to post as I am not able to pay bribe.
a) I purchased flat at andheri east on the last floor 3 yrs back { in the said society there are 108 flats – 6 bldgs – with total 12 terraces}.Mine is a last floor{4th floor}, during the 1st rains itself I had leakage in my flat, went & gave written complaint to the committee, who did not accept my complaint.
Meantime major repair works & beautification work was going on in the society for which each member contributed Rs.66,000/-, I too did the same.
So I got my self assured even if the committee did not take my complain, since the major work is carried on , they will include the terrace.
b) the 1st Rains got over , 2nd rains started, meantime I sent several complains through post/registrered ad.{Since they were not taking complaints when i personally approched them}, still no signs of terrance repairs.
c) In Jan 2009 I appointed a lawyer, who charged me Rs. 15,000/- to issue 2 notices to the committee, asking them why they are not doing the terrance, which was not recieved by the committee{They just do not take anyones complains -but does what they want to do}.
d) Lawyer told us we will approach the REGISTRARS “K” ward {dy.Registrar – Mr. Subash Patil } , for which he told we would had to pay bribe of Rs.15,000/-, for which we agreed, in days time Mr. Subash Patil issued notices to the society
1st asking them why the terrace repairs are not done
2nd they will be coming for inspection of society books etc.etc. on 6th March
I was happy that lastly things would be in my favour.
e) but when 6th march approach, whole day I sat in the premises looking out for the
Registrars, who did not turn up.
THE COMMITTEE MEMBERS OPENLY SAYS WE HAVE POCKETED THE REGISTRARS,
After which several times I went to the Registrar office at Wadala asking the reply to the 2 notices, but surprising they verbal say we are busy no time. I asked them to give me in writing, but failed to get anything in writing.
Lastly in April 2009 i put my RTI, asking for Indemity bond of the committee members with Wadala K ward, but yet not recieved any reply from the REGISTRARS.
