Bhopal:Thursday, August 7 :The State government has issued orders for remission in the sentences of prisoners incarcerated under various categories, on the occasion of Independence Day on August 15. This relaxation would be given to those inmates who are serving terms in Madhya Pradesh or other states’ jails after being convicted by judicial courts in Madhya Pradesh.
As per the order issued by the Jail Department in this connection, those prisoners who have undergone 15 years of sentence inclusive of remission and undertrial period after their imprisonment before December 18, 1978 would be released unconditionally.
Similarly, prisoners sentenced to imprisonment for life after December 18, 1978 and who have undergone 14 years of sentence inclusive of undertrial period and completed 20 years of sentence including remission on August 15, 2008 would also be released unconditionally.
All the women prisoners who have not been convicted for life imprisonment and who have served more than five years of actual sentence inclusive of undertrial period on August 15, 2008 shall have their unexpired part of sentence remitted and would be released.
Similarly, relaxation in jail term ranging from seven days to four months has been given to prisoners of various categories. This relaxation would not be given to habitual offenders and those who do not fall under remission system. All the blind prisoners eligible for relaxation under Jail Manual would also be released. Those prisoners would also be released unconditionally, who are suffering from cancer or TB and are on the verge of death and about whom medical certificates have been issued by the District Medical Board.
Prisoners aged 60 years or more who have completed half of their jail term would also be released from jail on August 15, 2008 inclusive of their undertrial period and fall under the remission system would also be released.
The state government has decided not to give any relaxation in the jail term to those prisoners whose investigation has been made by Delhi Special Police Establishment or any other competent authority and who have been found guilty of misappropriation of or damage to a property belonging to the Union government. Habitual offenders, security deposit defaulters and those jailed for not paying fine would also be not be entitled to relaxation. The prisoners booked under Dowry Prohibition Act, Prevention of Corruption Act, National Security Act, Drugs and Cosmetics Act, Foreign Exchange Regulation Act, Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, Employees Provident Funds and Miscellaneous Provisions Act, Prevention of Food Adulteration Act, Essential Commodities Act, Protection of Civil Rights Act, Customs Act, Madhya Pradesh Excise Act, Narcotic Drugs and Psychotropic Substances Act and Terrorist and Disruptive Activities (Prevention) Act would also not be entitled for any relaxation.
