Chandigarh 30th May : The Consumer Court in its verdict has ordered the Blood Donors Co-Op H/B Society, Chandigarh to refund the amount of Rs. 4,10,727 illegally charged interest from 2002 to 2008 with interest @ 9% per annum and further allowed a compensation of Rs. 50,000 on account of mental agony and harassment besides imposing the litigation cost of Rs. 10,000. Copy of Consumer Court judgment dated 21.5.2012, delivered on 30.5.2012 is attached.
The Blood Donors Co-Op H/B Society, Chandigarh had illegally deleted my name from the prospective list of allottees though I had deposited 25% of land cost by 24.5.2002 including the enhanced cost of land. The Society had adjusted my money against other non-paying members and sent the list to Chandigarh Housing Board by adding bogus members for extraneous consideration. It came to light in June, 2003. I had been running from pillar to post including Adviser, DC, Chandigarh, CVC and CBI for allotment of one category B flat but in vain.
On 5.4.2006, I filed a case under Section 55-56 of Punjab Cooperative Societies Act, 1861. The ARCS order to keep one category B flat reserve for me. Copy of order attached.
On 12.2.2008, the ARCS passed an award in my favour for allotment of one category B flat. The ARCS ordered to charge cost of land and cost of construction only. However, the Society did not act upon for 5 months and charged an amount of Rs. 4,10,727 on account of interest besides the cost of land and cost of construction i.e. 18,18,580. The interest was charged even for the delay caused by Society from February, 2008 to July, 2008 and further the possession of flat was not given till 22nd October, 2008. The Society was requested to refund the interest illegally charged from me but it did not pay heed. On 1.6.2010,I filed a complaint in Consumer Court, Chandigarh. On 21.5.2012, the Consumer Court has allowed the complaint against the Society and issued the above orders / directions.
