Subject :- Violation of RTI Act by Punjab State Information Commission.
Respected Sir,
Respectfully prayed that I filed a complaint with Punjab State Information Commission against Public Information Officer o/o Principal
Education Secretary Punjab for violation of RTI Act. The case no. CC
224/2011 titled ‘Tejinder Singh v. PIO, Education Secretary Punjab’
was disposed of by the Commission on the false statement given by the
respondent that the required information has been supplied to me (the
complainant).I sent email to the Commission on 09.04.2011 regarding the false
statement given by the respondent before the Commission. When no
response came I filed an RTI with the Commission itself to let me know
the action taken by the Commission on my complaint sent through email
regarding false statement. I sent the RTI application to the Commission
through courier on 02.05.2011, along with postal order and printout of
email dated 09.04.2011. However till date the Commission has not
replied to my RTI application.The scanned copies of the
application,postal order counter foil,POD of courier delivered are
attached with this email(3 pages).
In fact, the Commission (members and clerical staff) are hand-in-
glove with corrupt officials of Punjab Education Department.I have
filed a civil suit titled ‘Tejinder Singh v. State of Punjab’, pending
in the court of Ms Anupamish Modi, CJSD,Chandigarh to recover arrears
of my salary and allowances and seeking damages for harassment.Sh.
Jagtar Singh Khatra,the then DPI (SE) and Sh.KBS Sidhu, the then
Principal Secretary Education Punjab , have been made party in their
personal capacity.These officers failed to implement government’s own
orders passed in my favour on 07.03.2007, further clarified on
18.04.2007 in case no. 487 in the court of Sh. Sarvesh Kaushal, the
then Secretary Education Punjab. Ironically, the Department did not
challenge these orders nor bothered to implement the same.Hence I had
to file the case in judicial court, mainly to get the orders passed by
the Punjab Government itself implemented.Strangely , the state has now
taken a stand contrary to its own orders passed in my favour.The state
is also concealing the documents pertaining to the order passed by
Education Secretary in my favour.The scanned copy of order passed by
government on 18.04.2007 is given as attachment.I wanted to get
certified copy of this order, through RTI Act so that I may use the
same as evidence before court but I have been denied the same,thanks to
corruption in Punjab State Information Commission.
It is therefore respectfully prayed that appropriate action may
kindly be taken in this regard.
